Terms of Use

Two Second Media, Inc.

Effective Date: 10/20/2026
Last Updated: 10/25/2026

Welcome to Two Second Media.

These Terms of Use (“Terms”) govern your access to and use of twosecondmedia.com, the Two Second Media Experience, and related website features and services (collectively, the “Services”) operated by Two Second Media, Inc. (“Two Second Media,” “TSM,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, you should not use the Services.

1. Purpose of the Website

Two Second Media is a full-service media and production company offering services that may include video production, live event production, audiovisual services, content creation, event planning, and related professional services.

Our website provides information about our company, capabilities, services, and past work. It also provides tools for exploring potential projects and communicating with our team.

Information presented on the website is for general informational and project discovery purposes unless expressly stated otherwise.

2. The Two Second Media Experience

The Two Second Media Experience is an AI-powered project discovery and planning environment designed to help visitors explore their production needs, organize ideas, identify requirements, and communicate potential projects to Two Second Media.

The Experience may allow you to:

  • Discuss project concepts and production requirements with an AI assistant.

  • Develop structured project plans and creative preferences.

  • Upload reference materials and other project files.

  • Generate summaries, suggestions, and visual materials.

  • Create, save, and maintain project workspaces.

  • Invite collaborators to participate in project development.

  • Submit project information to Two Second Media for review.

The Experience is a planning and communication tool. It is not a substitute for professional production consultation, and its outputs are not binding commitments by Two Second Media.

3. Artificial Intelligence Limitations

The Experience uses artificial intelligence to generate responses and assist with project discovery.

AI-generated responses may be incomplete, inaccurate, outdated, or inappropriate for a particular project.

Although we seek to provide useful information, we do not guarantee that AI-generated content will be error-free, technically accurate, commercially suitable, or achievable within a particular budget or timeline.

The AI assistant is not authorized to:

  • Enter into contracts on behalf of Two Second Media.

  • Make binding commitments regarding pricing, availability, or scheduling.

  • Guarantee production outcomes or deliverables.

  • Approve project specifications or creative treatments on behalf of our production team.

  • Represent that a project has been accepted for production.

  • Provide final professional, legal, financial, engineering, or safety determinations.

You should independently evaluate AI-generated information before relying on it for significant decisions.

Only an authorized representative of Two Second Media may make binding commitments on behalf of the company, and only through an appropriate agreement or other expressly authorized written confirmation.

4. Estimates, Pricing, and Service Information

Our website and AI Experience may provide published starting prices, general pricing information, estimated ranges, or examples of typical production costs.

Such information is provided for planning purposes and does not constitute a binding quote or offer to perform services at a particular price.

Final pricing may depend on project scope, personnel, equipment, location, scheduling, creative requirements, licensing, travel, and other factors.

Any binding project pricing, deliverables, payment obligations, or production commitments will be established through a separate written agreement or expressly authorized written confirmation.

Submitting an inquiry or developing a project in the Experience does not guarantee availability or acceptance.

5. No Automatic Client Relationship

Using the website, communicating with the AI assistant, saving a project, or submitting a project handoff does not create a client relationship or obligate Two Second Media to provide production services.

A client relationship is established only when Two Second Media and the client enter into an applicable agreement or other expressly authorized arrangement.

Unless otherwise agreed in writing, Two Second Media has no obligation to reserve dates, personnel, equipment, facilities, or other resources based solely on information submitted through the website.

6. Eligibility and Authorized Use

You must be at least 18 years old to independently establish and manage a project workspace.

If you use the Services on behalf of a company, organization, or other entity, you represent that you have the authority to act on its behalf and to provide the information and materials you submit.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

7. Workspace Access and Identity

The Experience may offer verified identity, private project link access, or temporary sessions.

Certain features may require identity verification or additional authentication.

You are responsible for maintaining the security of your access methods, including email verification codes, authentication credentials, and private links.

If you choose to use an anonymous private link, you acknowledge that possession of the link may grant access to the associated workspace.

You are responsible for sharing such links only with individuals you intend to authorize.

Two Second Media is not responsible for unauthorized access resulting from your voluntary disclosure of a valid private link, except to the extent caused by our own conduct or as otherwise required by law.

8. Collaboration and Workspace Ownership

The Experience may support shared workspaces in which multiple individuals can access project information.

Depending on the available permissions, workspace members may view and modify shared conversations, project plans, uploaded materials, and other workspace content.

Workspace owners may have additional administrative rights, including inviting or removing collaborators and deleting projects.

You are responsible for ensuring that collaborators are authorized to access and contribute to the workspace.

You acknowledge that changes made by authorized collaborators may affect shared project information.

Two Second Media is not responsible for disagreements among collaborators regarding project ownership, access, submitted materials, or authority to act on behalf of an organization.

We may restrict access when reasonably necessary to address a credible ownership dispute, suspected unauthorized activity, or other security concerns.

9. Your Content and Intellectual Property

You retain ownership of the original content and intellectual property rights that you lawfully hold in materials you submit to the Services.

This may include project descriptions, photographs, videos, graphics, documents, scripts, creative concepts, and other original materials (“User Content”).

By submitting User Content, you grant Two Second Media a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, analyze, and display that content solely as reasonably necessary to:

  • Operate and provide the Services.

  • Generate requested AI-assisted responses and project materials.

  • Maintain project workspaces and collaboration functionality.

  • Prepare and review project submissions.

  • Respond to inquiries and evaluate potential production services.

  • Maintain security, investigate misuse, and comply with applicable law.

This license does not transfer ownership of your User Content to Two Second Media.

You represent that you own or otherwise possess the rights and permissions necessary to submit your content and authorize its processing as described in these Terms.

You agree not to upload materials that infringe another party's intellectual property, privacy, confidentiality, or other legal rights.

10. Confidential and Proprietary Information

We recognize that project discussions may involve business plans, creative concepts, unreleased materials, and other information that visitors consider confidential.

We handle submitted information in accordance with our Privacy Policy and applicable legal obligations.

However, use of the website or Experience does not, by itself, establish a nondisclosure agreement, fiduciary relationship, or contractual duty of confidentiality beyond obligations imposed by applicable law or a separate written agreement.

Information submitted through the Experience may be processed by third-party technology and AI providers as described in our Privacy Policy.

If your project involves highly confidential information, trade secrets, restricted materials, or information subject to a separate confidentiality obligation, please contact Two Second Media to discuss appropriate arrangements before submitting those materials.

Two Second Media will not acquire ownership of your original project concepts merely because you submit them through the Experience.

11. AI-Generated Content

The Experience may generate text, summaries, project plans, recommendations, images, or other materials (“AI Output”).

Subject to applicable law and third-party rights, you may use AI Output generated for your project for lawful project planning and evaluation.

However:

  • AI Output may not be unique to your project.

  • Similar outputs may be generated for other users.

  • AI Output may not qualify for copyright or other intellectual property protection.

  • AI Output may contain inaccuracies or material requiring verification.

  • AI Output may be subject to applicable third-party rights or technology-provider restrictions.

Two Second Media does not guarantee exclusivity, originality, copyrightability, or freedom from third-party claims regarding AI Output.

Any ownership, licensing, or usage rights relating to professional creative deliverables produced by Two Second Media will be governed by the applicable production agreement.

12. Two Second Media Intellectual Property

Unless otherwise indicated, the website's design, branding, logos, text, original photographs, videos, graphics, software, and other content owned by Two Second Media are protected by applicable intellectual property laws.

The Two Second Media name, branding, and associated marks may not be used in a manner that suggests endorsement, sponsorship, or affiliation without authorization.

You may view and use website content for legitimate personal or business evaluation purposes.

You may not reproduce, redistribute, sell, or commercially exploit our proprietary website content without prior written authorization, except as permitted by applicable law.

Nothing in these Terms transfers ownership of Two Second Media's preexisting intellectual property.

13. Project Saving, Submission, and Deletion

The Experience may allow you to save projects, create additional conversations, revise project plans, and submit project handoffs.

Saving a project does not constitute submission to our production team unless the applicable feature expressly indicates otherwise.

Submitting a project handoff may create a historical record of the project information at the time of submission.

Subsequent edits may not automatically modify earlier submitted records.

Project deletion may be subject to access permissions, technical limitations, legal obligations, and recordkeeping requirements.

You are responsible for maintaining independent copies of important materials.

We do not guarantee that project information will remain available indefinitely or that deleted information can be recovered.

14. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful, fraudulent, abusive, or deceptive purposes.

  • Upload malicious software or attempt to compromise website security.

  • Access projects, accounts, or data without authorization.

  • Attempt to bypass authentication, access controls, or usage restrictions.

  • Interfere with the operation or availability of the Services.

  • Use automated tools to excessively access, scrape, or overload our systems.

  • Submit content that infringes third-party rights.

  • Impersonate another individual or misrepresent your authority.

  • Use the Experience to generate unlawful content or facilitate harmful activity.

  • Attempt to manipulate the AI assistant into revealing private information, internal instructions, system credentials, or information belonging to other users.

We may suspend or restrict access when reasonably necessary to protect the Services, users, or our legitimate business interests.

15. Website Availability and Changes

We may modify, suspend, discontinue, or replace website features, including AI capabilities, collaboration tools, project storage features, and other functionality.

We do not guarantee uninterrupted availability, compatibility with every device, or permanent preservation of any particular feature.

Maintenance, technical failures, security incidents, and third-party service disruptions may affect availability.

Where reasonably practicable, we may provide advance notice of significant changes affecting established project workspaces.

16. Third-Party Services and Links

Our website may integrate with or link to third-party platforms, including streaming services, payment providers, authentication systems, AI providers, social media platforms, and other external services.

These services may be governed by separate terms and privacy policies.

Two Second Media does not control independently operated third-party services and is not responsible for their content or operations, except as required by applicable law.

17. Professional Services and Separate Agreements

Any production services performed by Two Second Media are subject to the applicable proposal, service agreement, production contract, statement of work, or other authorized written agreement.

Such agreements may address project scope, deliverables, pricing, payment schedules, cancellations, rescheduling, licensing, intellectual property, liability, and other commercial terms.

If a separately executed agreement conflicts with these Terms concerning the professional services covered by that agreement, the separately executed agreement will control for those services.

These website Terms do not replace an executed production agreement.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, INCLUDING THE TWO SECOND MEDIA EXPERIENCE AND AI OUTPUT, ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TWO SECOND MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE AGAINST EVERY POSSIBLE THREAT, OR SUITABLE FOR EVERY INTENDED PURPOSE.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWO SECOND MEDIA AND ITS OFFICERS, EMPLOYEES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICES.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR RELIANCE ON AI-GENERATED INFORMATION, TO THE EXTENT SUCH EXCLUSIONS ARE PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWO SECOND MEDIA'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE WEBSITE SERVICES UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO TWO SECOND MEDIA SPECIFICALLY FOR THE AFFECTED WEBSITE SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THIS LIMITATION DOES NOT MODIFY LIABILITY EXPRESSLY GOVERNED BY A SEPARATE EXECUTED PRODUCTION AGREEMENT.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

20. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Two Second Media, Inc. and its officers, employees, and representatives from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the Services.

  • Your material violation of these Terms.

  • Your submission of content that infringes another party's rights.

  • Your unauthorized disclosure of confidential information or project materials.

  • Your misuse of project access or collaboration features.

This provision does not require you to indemnify Two Second Media for its own negligence, willful misconduct, or other conduct to the extent prohibited by applicable law.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles, except where mandatory applicable law requires otherwise.

Subject to applicable jurisdictional requirements, disputes arising from these Terms or use of the Services shall be brought before the appropriate state or federal courts located in Maricopa County, Arizona.

Nothing in this section prevents a party from exercising rights or remedies that cannot lawfully be waived.

22. Termination and Suspension

We may suspend or terminate access to the Services if we reasonably believe that you have violated these Terms, compromised security, engaged in unlawful activity, or created a material risk to the Services or other users.

You may stop using the Services at any time.

Termination does not automatically eliminate obligations or rights that accrued before termination, including lawful recordkeeping obligations and provisions intended to survive termination.

23. Changes to These Terms

We may revise these Terms to reflect changes in our Services, business operations, or legal requirements.

Updated Terms will be posted on our website with a revised “Last Updated” date.

Where required by law, we will provide additional notice or obtain consent before material changes take effect.

Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.

24. Severability and Entire Agreement

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with our Privacy Policy and any applicable additional website terms, govern use of the Services.

Separate executed agreements govern the professional services covered by those agreements.

Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.
